First, ask yourself if it’s safe to do so and if you can be calm during the interaction without help from law enforcement. While emotions may be running high, it’s important not to lay blame on the driver or yourself. If you decide to speak to the other driver, avoid:

  • Saying you’re sorry and other admissions of guilt, even if you feel you’re at fault.
  • Expressing anger towards the other driver, even if you feel they’re at fault.
  • Discussing who is at fault in the accident.
  • Speaking about injuries.

It’s important, especially in interactions with the other driver before police arrive on the scene, to not make any deals with them. If they offer to pay for any damage in order to keep insurance out of the situation, claim they don’t have insurance but will pay you or make some other offer, never agree to it.

Collect Information

Before leaving the scene, you must exchange insurance and contact information. If the police are present, they will help with this process to ensure everything is in order. You will need your car registration and proof of insurance, which should be kept in your car at all times, as well as your ID and contact information.

Contact your car insurance provider as soon as possible to find out what information you need to provide and what you’re entitled to. Once a claim is filed, the insurance company will determine who is at fault and begin the process of resolving the claim.
